Waiver and Release Agreement

 

I, the undersigned, hereby acknowledge and agree to the terms set forth in this Release of All Claims, Waiver of Liability, and Assumption of Risk (“Waiver and Release”) with respect to my participation in the Jeep Tour organized by The Marano Method LLC, d/b/a Bucks County Joyrides (“Bucks County Joyrides”).

I waive any and all claims, both present and future, and release Bucks County Joyrides, its officers, agents, representatives, employees, and tour guides (“Staff”) from all liability. I agree not to hold Bucks County Joyrides or its Staff responsible for any personal injury, death, property damage, or loss that may arise from my participation in the Jeep Tour, to the fullest extent permitted by Pennsylvania law, whether caused by ordinary negligence of Bucks County Joyrides, its Staff, or other participants, or resulting from war, civil unrest, or epidemic.

Assumption of Risk

I acknowledge that the Jeep Tour involves inherent and specific risks, including but not limited to: travel over rough, uneven, or unpaved terrain; sudden stops, jostling, tipping, or vehicle rollover; exposure to weather, dust, insects, and wildlife; travel in remote areas where emergency response may be delayed; physical exertion including entering and exiting the vehicle; and the acts of other participants or third parties. I accept these risks and release Bucks County Joyrides and its Staff from liability arising from them, to the extent permitted by law.

I agree that if I suffer injury or illness during the Jeep Tour, Bucks County Joyrides or its Staff may, at my expense, arrange necessary medical treatment and emergency evacuation services for my health and safety.

Photo, Video, and Marketing Release

I grant Bucks County Joyrides permission to photograph and record me during the Jeep Tour and to use such photographs, video, and recordings in its marketing and promotional materials, including social media, website, and advertising, without compensation to me. If I do not wish to be included, I will notify my tour guide in writing before the tour begins.

I further agree to comply with all instructions provided by my tour guide or other Staff members during the Jeep Tour, understanding that failure to do so may result in injury, death, or permanent disability, and may result in my removal from the tour without refund.

I confirm that I have read and understood the Terms and Conditions of the Jeep Tour and this Waiver and Release Agreement. I acknowledge that my participation in the Jeep Tour is voluntary, that I am signing this agreement freely and without duress, and that I am not relying on any representations or inducements by Bucks County Joyrides or its Staff to participate. I acknowledge that I have had the opportunity to seek independent legal advice regarding this agreement before signing.

I accept full responsibility for my behavior, well-being, and health during the Jeep Tour, and I agree to indemnify and hold harmless Bucks County Joyrides and its Staff from any claims, damages, or costs arising from my own acts or omissions during the tour, including harm caused to other participants or third parties.

Minors

If a participant is under 18 years of age, this Waiver and Release must be read, signed, and agreed to by that participant’s parent or legal guardian, who agrees to all terms herein on the minor’s behalf.

Governing Law and Severability

This Waiver and Release shall be governed by the laws of the Commonwealth of Pennsylvania. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

By purchasing the Jeep Tour, I affirm that I have fully understood and agreed to the Terms and Conditions and this Waiver and Release Agreement outlined herein.
